Family law in the Netherlands (familierecht) governs the legal relationships between individuals within the context of marriage, divorce, children, parentage, and inheritance. It is a sensitive and often emotionally charged area of law. At Gimbrere Legal, our family law attorneys provide empathetic yet strategic legal support to help clients navigate difficult personal circumstances with clarity and confidence.
For international child abduction or succession within a family, also see international child abduction in the Netherlands and Dutch inheritance law.

In the Netherlands, two types of formal relationships are legally recognized: marriage and registered partnerships. Both forms offer similar rights and obligations under Dutch law, including community property rules, maintenance duties, and inheritance rights. Couples can opt for a prenuptial agreement (huwelijkse voorwaarden) to regulate their financial relationships differently. Our attorneys at Gimbrere Legal can advise on the drafting and enforcement of such agreements.
Divorce in the Netherlands can be initiated unilaterally or jointly. The procedure starts with a petition to the district court (rechtbank) and can be straightforward in uncontested cases. More complex divorces may involve disagreements about child custody, alimony, and property division. Legal separation (scheiding van tafel en bed) is less common but still available.
Gimbrere Legal assists clients throughout the divorce process, including mediation, settlement negotiations, and litigation when necessary. Our attorneys ensure that your financial and parental interests are safeguarded.

Parental authority (ouderlijk gezag) concerns the rights and responsibilities involved in raising a minor child and taking important decisions. Parents who already have joint parental authority normally retain it after divorce or separation; the court can award sole authority where the statutory conditions are met. Authority is separate from the child’s main residence and the division of day-to-day care. Disputes may concern residence, contact arrangements, school choice, relocation or medical decisions, and must be assessed with the child’s interests in mind.
Our lawyers support parents in drafting parenting plans (*ouderschapsplan*), negotiating arrangements, and pursuing court proceedings when consensus is impossible. We always prioritize the welfare of the child, while firmly defending your parental rights.

Financial support is an essential aspect of family law. In the Netherlands:
The duration and amount of maintenance depend on factors such as the length of the marriage, income differences, and future earning potential. Our attorneys at Gimbrere Legal can represent both paying and receiving parties in maintenance disputes and modification requests.
Dutch law offers several legal remedies for individuals affected by domestic violence, including:
Family law attorneys at Gimbrere Legal can request protective measures on behalf of clients facing physical or emotional abuse. We also defend those wrongfully accused, ensuring fair treatment under the law.
Recognition (erkenning) establishes legal parenthood and must be distinguished from parental authority (ouderlijk gezag). Since 1 January 2023, an unmarried or non-registered partner who recognises a child normally acquires joint parental authority with the mother automatically. Statutory exceptions apply, including where the mother and the recognising parent declare that only the mother will exercise authority. Recognition before 1 January 2023 does not itself create joint authority, even if the child was born later. In those cases, a separate application may be necessary. International parentage and authority questions also require assessment of jurisdiction and applicable law. Our lawyers assist parents in determining their legal position and arranging appropriate authority and care arrangements.
Parental relocation after divorce can trigger complex legal conflicts, especially when one parent wishes to move abroad with the child. Dutch courts weigh the child’s welfare, ties with both parents, and educational and social stability.
In cases of unauthorized removal or retention of a child across borders, the Hague Convention on International Child Abduction applies. Gimbrere Legal has extensive experience with urgent return proceedings and international custody enforcement.
Family law in the Netherlands intersects with inheritance law, particularly regarding:
Our attorneys advise families on drafting wills, resolving estate conflicts, and ensuring fair distribution of assets according to Dutch inheritance law.
A lawyer must submit a divorce petition to the Dutch court. Where both spouses agree, a joint petition may be possible. Disputes about children, maintenance or assets may require additional advice and representation.
A parenting plan records arrangements for children, including care, information sharing and costs. It is generally required when parents divorce with minor children in the relevant circumstances; practical or legal exceptions must be assessed individually.
The assessment considers the applicable rules, financial circumstances and relevant needs and ability to pay. Provide current income and expense information; child and spousal maintenance should not be treated as the same calculation.
A change may be possible where the legal requirements are met, for example following a relevant change in circumstances. Check whether a new agreement is sufficient or a court application is needed before departing from an existing order.
That depends on jurisdiction rules and the specific issue. Divorce, parental responsibility, maintenance and property division can require separate assessments of residence, nationality, applicable law and existing proceedings.
If you need advice, help or representation from an experienced lawyer, Gimbrere Legal is here for you. We meet clients at our offices and country-wide and world-wide via video conference meetings wherever in the world you are.
The Netherlands was the first country to legalize same-sex marriage in 2001. Today, same-sex couples enjoy equal rights in all areas of family law, including marriage, adoption, custody, and inheritance. Nevertheless, legal procedures such as co-parenting agreements and donor recognition can still be complex. Gimbrere Legal provides tailored legal advice to LGBTQ+ families, ensuring full recognition of their family relationships under Dutch law.
Family law issues often involve more than legal consequences—they affect people’s lives deeply. At Gimbrere Legal, we understand the emotional and practical impact of family conflicts. Our attorneys offer clear, compassionate, and effective legal guidance.
